Customer Terms and Conditions Agreement

I represent that I (herein, “Customer”) am the owner, or am acting as a duly authorized agent of and have authority to bind, the owner of the above-described equipment (the “Equipment”). I hereby authorize the necessary diagnostic/repair work to be done along with the necessary parts and material. I understand that estimates are not definitive pricing and acknowledge that these estimates provided by Precision Diesel are based on preliminary inspection, subject to change, and do not cover any additional parts/labor that may be required after the work has commenced or as a result of further investigation. Worn or damaged parts may be discovered that were not evident on the initial inspection. Estimated prices are not guaranteed. Quotations on parts and labor are current and subject to change. I, Customer, promise to pay for any applicable service call fees, parts run fees, diagnostic services, disassembly services, reassembly services, and repair work, together with all charges for any repairs and time spent working on Customer Equipment, regardless of outcome, (collectively, the “Charges”), and I understand that Precision Diesel will have a lien on the Equipment in the event I fail to pay the Charges when due. I understand that regardless of outcome the minimum charges once a service call has been requested and approved by Customer will include no less than 1 service call fee and 1 hour of labor at the current applicable rates (“Minimum Fee”). I understand that all Charges are due and payable immediately to Precision Diesel upon completion of service and receipt of invoice. I understand that the work performed by Precision Diesel is not covered by any warranty, and I agree to pay any Charges that are not covered by a warranty, if any. I understand that if Precision Diesel arrives on-site and the worksite is unsafe to perform services, at the sole and absolute discretion of Precision Diesel, the Minimum Fee will still be due in addition to any other fees for parts, parts runs, or other services provided.
I hereby authorize the repair work herein set forth to be completed along with the necessary material and agree that Precision Diesel is not responsible for loss or damage to Equipment or articles left in Equipment in case of fire, theft or any other cause. An express garage keeper’s lien is hereby acknowledged on above Equipment to secure the amount or repairs thereto. A 3.2% + ($0.30) convenience fee will be added to the total invoice amount for payments made by credit card. You may avoid this fee by paying with EFS check or ACH transfer. By approving this estimate, you acknowledge and accept this additional fee if you choose to pay by credit card. This fee reflects the cost incurred by our payment processor.

24-Hour Cancellation Policy
To ensure Precision Diesel can efficiently serve all customers and properly schedule our mobile repair technicians, the following cancellation policy applies to all confirmed and approved estimates, service orders, and appointments:
1. Required Notice
Same day services cannot be cancelled once approved. Cancellations must be made at least 24 hours prior to the scheduled service time.
2. Late Cancellation or No-Show Fee
If an appointment is canceled less than 24 hours in advance, or if our technician arrives on-site and is unable to perform the service due to customer-related issues (no access, vehicle not present, etc.), the customer will be charged Minimum Fee:
Minimum Fee = service-call fee, plus one (1) hour of labor (based on the current service call fee and hourly labor rate at the time of the scheduled service).
3. Reason for Policy
Mobilizing a heavy-duty repair technician involves significant planning, travel time, and resource allocation. Short-notice cancellations prevent us from filling the time slot and impacts our ability to serve other customers efficiently.
4. How to Cancel
To avoid cancellation charges, cancellations must be submitted via:
- Phone call to dispatch; or
- Text message to our dispatch line with receipt confirmation; or
- Email (timestamp must show at least 24 hours’ notice) with receipt confirmation.
5. Acceptance of Policy
By scheduling a service appointment, the customer acknowledges and agrees to this cancellation policy.
Refund & Return Policy
To maintain fairness, efficiency, and transparency in our operations, the following refund policy applies to all services and parts provided:
1. Refund Eligibility for Cancellations
Refunds are only available for appointments cancelled more than 24 hours before the scheduled service time.
2. Refunds for Parts with Restocking or Return Fees
Any parts eligible for return that carry manufacturer or supplier restocking fees or return fees will be refunded minus those applicable charges. Customers are responsible for all restocking or return fees.
3. Cancellations Within 24 Hours
If an appointment is canceled less than 24 hours in advance, or if our technician arrives on-site and is unable to perform the service due to customer-related issues (no access, vehicle not present, etc.), the customer will be charged Minimum Fee:

4. No Refunds After Parts Are Installed
Once any part has been installed, it is no longer eligible for a refund under any circumstances.
5. Labor Is Non-Refundable Once Performed
All labor performed—whether diagnostic, repair, or other service—is non-refundable once provided.
Disclaimer of Warranties, Disputes, Returns/Refunds:
Any disputes regarding services or parts must be submitted in writing within five (5) days of the invoice date. Failure to dispute within five (5) days of the invoice constitute acceptance of the invoice as accurate and complete. In the event of non-payment, Customer agrees to pay all collection costs, attorney fees, and court costs incurred by Precision Diesel. Any warranties on the products sold hereby are those made solely by the manufacturer. Precision Diesel hereby expressly disclaims all warranties, either express or implied, including any implied warranty of mechanical ability or fitness for a particular purpose in connection with the products or services sold hereby.
Precision Diesel neither assumes nor authorizes any other person to assume for it any liability in connection with the sale of said products or services. All claims and returned goods must be accompanied by this document.

Limitation of Liability:
The maximum liability of Precision Diesel and its affiliated entities to Customer for damages arising out of this agreement and any services provided by Precision Diesel and any parts sold or provided to Customer by Precision Diesel is limited to the amount paid to Precision Diesel by Customer under this agreement. Under no circumstances will Precision Diesel be liable for any indirect, incidental, special or consequential damages, including but not limited to loss of revenue or lost profits, or damages that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, delays in operation or transmission, failure of performance or destruction of Precision Diesel’s records, programs or services, even if Customer has been advised of the possibility of such damages.
Miscellaneous:
Replaced parts will not be returned to Customer unless requested in writing by Customer at the time of repair. Customer agrees that Precision Diesel is not responsible for loss or damage to (i) the Equipment, (ii) articles left in the Equipment or (iii) trailer (and cargo contained in trailer), whether such trailers are attached to or detached from the Equipment, in case of fire, theft or any other cause. Customer agrees Precision Diesel is not responsible for any delays in repairs or any downtime, including without limitation delays or downtime caused by the unavailability of parts or delays in parts shipments by the supplier or transporter. Customer hereby grants Precision Diesel and/or Precision Diesel employees’ permission to operate the Equipment on streets, highways or elsewhere for the purpose of testing, inspection and/or delivery.
